Terms of Service

Welcome to Nightstand. These Terms of Service govern your use of the Nightstand mobile application. By downloading, accessing, subscribing to, or using Nightstand, you agree to these Terms.

If you do not agree to these Terms, please do not use the app.

1. About Nightstand

Nightstand is a personal book-tracking app that helps you manage books you want to read and books you have read. You can add book information manually, paste links, select cover images from your photo library, add notes, track reading formats, ratings, reviews, genres, and finished dates.

Nightstand is intended for personal organization and reference.

2. Your Information and Content

You are responsible for the book entries, notes, reviews, ratings, links, and other information you add to Nightstand.

You retain ownership of the content you enter into the app. Nightstand does not claim ownership of your book lists, notes, reviews, or other personal content.

If you use iCloud sync, your app data may be stored and synced through Apple's iCloud services. Your use of iCloud is also subject to Apple's applicable terms and policies.

3. Book Lookup and Third-Party Information

Nightstand may help identify books from typed titles, pasted URLs, or other input. Book information may come from third-party sources or public metadata services.

Book lookup results may be incomplete, inaccurate, unavailable, or mismatched. You are responsible for reviewing and confirming any detected book information before saving it.

Nightstand is not affiliated with, endorsed by, or sponsored by any retailer, publisher, author website, metadata provider, or book database unless expressly stated.

4. Photos

Nightstand may let you select a photo from your photo library to use as a custom cover image for a book.

You should only use photos that you have the right to use. Do not use the app to process unlawful, harmful, or privacy-invasive content.

5. Acceptable Use

You agree not to misuse Nightstand or attempt to interfere with its normal operation. You may not use the app to:

• violate any applicable law
• infringe someone else's rights
• attempt to reverse engineer, disrupt, or damage the app
• submit malicious, deceptive, or harmful content
• use automated means to overload lookup or related services

6. App Availability and Changes

Nightstand may change over time. Features may be added, modified, or removed. Most interactive features require an active subscription. If your subscription is inactive, Nightstand may operate in a limited read-only mode.

Some functionality, including iCloud sync and book lookup, may depend on Apple services, internet access, third-party services, or device capabilities.

We do not guarantee that the app or any feature will always be available, uninterrupted, accurate, or error-free.

7. Subscriptions, Billing, Cancellation, and Access

Nightstand may offer paid access through auto-renewing subscriptions, including monthly and annual subscription options. Subscription pricing, duration, trial availability, and included features will be shown in the app and in the App Store before you purchase.

All subscriptions are processed by Apple through your Apple ID. Billing, renewal, cancellation, refunds, and payment issues are handled by Apple and are subject to Apple's applicable terms and policies.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. You can manage or cancel your subscription in your Apple ID subscription settings.

If a subscription includes a free trial or introductory offer, Apple may charge you when the trial or introductory period ends unless you cancel before the deadline shown by Apple.

If your subscription or trial ends, expires, is canceled, or otherwise becomes inactive, you may continue to keep Nightstand installed and view books you previously added. You may also export your previously added book data where export functionality is available. However, access to most app features may be disabled without an active subscription, including adding books, editing book details, importing books, sharing books, book lookup, OCR-based lookup, and other interactive or premium features.

We may change subscription pricing or features in the future. Any pricing changes will be handled through Apple and, where required, Apple will notify you or ask for your consent before the change takes effect.

Except where required by law or Apple policy, payments are non-refundable. Refund requests must be submitted to Apple.

8. Apple App Store Terms

If you downloaded Nightstand from the Apple App Store, your use of the app is also subject to Apple's applicable App Store terms and the Apple standard licensed application end user license agreement, unless a separate end user license agreement applies.

9. Intellectual Property

Nightstand, including its design, software, branding, and original content, is owned by Octopus Consulting Co LLC and is protected by applicable intellectual property laws.

These Terms do not give you any ownership rights in Nightstand. You are granted a limited, personal, non-transferable right to use the app in accordance with these Terms.

10. No Professional Advice

Nightstand is a personal organization tool. It does not provide professional, educational, legal, financial, or publishing advice.

11. Disclaimer of Warranties

Nightstand is provided "as is" and "as available." To the fullest extent permitted by law, Octopus Consulting Co LLC disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Octopus Consulting Co LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, or loss of goodwill arising from or related to your use of Nightstand.

13. Termination

You may stop using Nightstand at any time. We may suspend or discontinue access to the app or any feature if necessary to protect the app, comply with law, or address misuse.

14. Governing Law

These Terms are governed by the laws of California, USA, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date. Continued use of Nightstand after changes become effective means you accept the updated Terms.
